Hours of Service for Livestock Haulers Emergency Declaration Extended Through Feb. 2021

The Federal Motor Carrier Safety Administration (FMCSA) extended the Hours of Service (HOS) emergency declaration for livestock and livestock feed (finished feed) haulers until Feb. 28, 2021. The emergency declaration also applies to medical supplies and equipment, as well as personal protective equipment and disinfectants.

Additionally, FMCSA released an interim final rule on the definition of an agricultural commodity for use in determining which products are eligible to be hauled under the 150 air-mile exemption from HOS. The rule codifies the definition of “agricultural commodity” to mean “any agricultural commodity,” non-processed food,” and “livestock.” Clarification ensures that HOS exemptions are consistently understood and enforced. The new definition of agricultural commodity will go into effect 15 days after publication of the interim final rule. FMCSA has provided 30 days for public comments prior to publication.
