The morning session addressed topics of interest to anyone involved with transport of animals. Following the conclusion of AATA's 31st International Conference at noon, the afternoon session focused specifically to livestock trucking issues. |

The Transportation Defense Lawyers Network (TDLN) is a network of law firms which have, over the years, become specialists in representing transportation companies-trucking companies, railroads, bus companies, aviation companies and maritime companies-in all manner of legal disputes. These firms have come together to offer the transportation industry a better way to obtain legal services. The presentation focused on various ways in which trucking companies can find themselves liable for something a driver does, or doesn't do, following an accident. It covered liability for leased vehicles as well as owned vehicles and the need for companies to be incorporated to protect personal assets. Kevin spent many summers working at his uncle’s dairy farm, which influenced his future career path. Kevin graduated from the University of Guelph with a diploma in Agriculture and worked at various farm operations after graduation. He started employment with The Hartford Insurance Livestock Department in 1983. He also holds a CIP designation from the Insurance Institute of Canada. The nature of Hartford’s insurance policies expose many hazards animals must deal with in transit. Kevin will address what the hazards are and risk management tools to deal with those hazards.

Insurance for Death, Injury and Bruising

The nature of the livestock industry requires the animals be moved during their production cycle. Livestock are transported into auction markets, packinghouses, pastures, or other farms both near and far. Moving animals has evolved from herding, to railways, to present day motor truck transport. Trucks vary in size and shape. They range from 8-foot single animal stock trailers, to different size bodyjobs, up to 52-foot multideck liners. Livestock is like no other commodity transported. It is living and breathing. It constantly moves and shifts during transport. The cargo is someone’s animals that they have raised since birth. Hauling livestock is not the same as hauling “general freight”. The process of “Protecting Your Cargo” begins as soon as a livestock owner/producer decides his animals need to be moved. In most cases the livestock are the primary source of income for the cattleman or hog producer and therefore it’s very important for his stock to get to destination safely, with no death, injury and with minimal stress. The transportation exposes that investment to many hazards, including a truck accident and the loss of the entire cargo. Insurance is one tool the trucker and livestock owner must understand as a means to financially protect their business. This presentation will explain the insurance policies available to the trucker and livestock owner. Cargo insurance policies are designed to protect the commercial trucker against their legal liability for losses when the truck is involved in an accident. There are also insurance polices available to the livestock owner designed to cover the animals against death, crippling or injury losses. We will also identify the many hazards that are inherent with the movement of livestock. The process of moving livestock does not just involve the trucking from origin to destination. The animals must be gathered, sorted, funneled to a loading area, driven up a ramp, loaded, transported, and unloaded at destination. There are hundreds of hazards the animals are exposed to. Any one of these hazards has the potential to injure, cripple, bruise or kill the animal. The combination of the trucker and livestock owner and their understanding of the many aspects involved in transporting livestock will result in the safe and humane handling, with minimal loss and stress to the animals
